Terms of Service
Effective date: 13 June 2025
1. Who we are
Makane ("Makane", "we", "us", or "our") is an online booking platform operated by an individual sole trader. Our platform is accessible at makane.me and any associated subdomains or mobile applications.
By creating an account, subscribing to a paid plan, or using any part of our service, you ("you", "Shop Owner", or "User") agree to these Terms of Service ("Terms"). If you do not agree, please do not use Makane.
2. The service
Makane provides:
- A branded online booking page for your business
- A staff scheduling and availability management system
- Customer-facing booking flows with email confirmations and reminders
- An admin dashboard with analytics, booking management, and settings
- Optional multi-language support (English, Arabic, French)
We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable notice.
3. Account registration
To use Makane you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account. By registering, you represent that you meet this requirement.
You may not share your account with third parties or create multiple accounts to circumvent plan limits or restrictions.
4. Subscriptions and payment
Makane offers paid subscription plans ("STARTER" and "PRO") billed monthly or annually. Prices are displayed in USD on our pricing page and are subject to change with 30 days' notice.
Subscriptions renew automatically at the end of each billing period. You authorise us to charge the payment method on file for each renewal.
Free trial periods, where offered, convert automatically to a paid plan at the end of the trial unless cancelled beforehand. No charge is made during the trial period.
We use third-party payment processors. We do not store full card details on our servers.
5. Cancellation
You may cancel your subscription at any time from your account dashboard or by contacting us at support.makane@gmail.com.
Cancellation takes effect at the end of the current billing period. You will retain full access to paid features until that date. We do not issue prorated refunds for mid-period cancellations, except where required by applicable law or our Refund Policy.
Upon cancellation your data is retained for 30 days, after which it may be permanently deleted.
6. Acceptable use
You agree not to use Makane to:
- Violate any applicable law, regulation, or third-party right
- Upload or transmit malware, spam, or malicious content
- Scrape, reverse-engineer, or attempt to extract source code from the platform
- Impersonate any person or entity
- Conduct fraudulent bookings or manipulate the booking system
- Circumvent any security or access controls
- Use the service in any way that disrupts its availability to other users
We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.
7. Your data and your customers' data
When you use Makane, you collect personal data from your customers (names, email addresses, phone numbers) through the booking form. You are the data controller for this customer data under applicable privacy laws (including GDPR where applicable). Makane acts as a data processor on your behalf.
You are responsible for ensuring you have a lawful basis for collecting and processing your customers' personal data, and for maintaining an appropriate privacy notice on your own business.
Our collection and use of your personal data (as a Shop Owner) is governed by our Privacy Policy.
8. Intellectual property
Makane and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any content you upload (logos, business information, service descriptions). By uploading content to Makane, you grant us a non-exclusive, worldwide, royalty-free licence to display and deliver that content as necessary to provide the service.
You may not use the Makane name, logo, or trademarks without our prior written consent.
9. Third-party services
Makane integrates with third-party services including payment processors, email delivery providers, and calendar systems. Your use of these integrations is also subject to those third parties' own terms of service and privacy policies. We are not responsible for the practices of third-party services.
10. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or completely secure. You use the service at your own risk.
11. Limitation of liability
To the maximum extent permitted by applicable law, Makane shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising from these Terms or the service shall not exceed the total amount paid by you to Makane in the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Makane and its operators from any claim, liability, damage, loss, or expense (including legal fees) arising out of: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit through the platform.
13. Governing law and disputes
These Terms are governed by the laws of Lebanon, without regard to conflict-of-law principles. For users located in the European Union, mandatory consumer protection rights under EU law are not affected.
Any dispute arising from these Terms shall first be attempted to be resolved by good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to the courts of competent jurisdiction in Lebanon.
EU users may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, notify registered users by email or in-app notice at least 14 days before the change takes effect.
Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
